What are the copyright issues when making a recording using the SmartMusic accompaniment?

I asked MakeMusic for an official answer. Here it is:


"Copyright reminder: U.S. and international law gives the copyright owner exclusive right to reproduce the copyrighted work
in copies or phonorecords. "Phonorecords" refers to all of the many ways in which a work can be recorded aurally. It is your
responsibility to be sure that the music you record is in the public domain, or that you have permission from the copyright owners before you record their works. For further information on copyright, see "The United States Copyright Law: A Guide for Music Educators" at http://www.menc.org/information/copyright/copyr.html or visit the U.S. Copyright Office at http://www.loc.gov/copyright/."

If someone wants to make a CD using our accompaniments, they need to contact us for a license to use our accompaniments in this way. And, because the licenses we have with the music copyright owners to create SmartMusic accompaniments do not include the right to use our accompaniments to make recordings for other than personal use with SmartMusic, they will need to contact the music copyright owner for a mechanical license to record the music.

There is a good, easy to read and understand book written by Jay Althouse that is very useful when dealing with copyright questions. It is called "COPYRIGHT: The Complete Guide for Music Educators". It is published by Alfred Publishing.
